Terms of Service

1. Our Services

The Services are not offered where their distribution or use would violate law or require us to register. People accessing them elsewhere are responsible for complying with applicable local law.

2. Intellectual Property Rights

We own or license the Services’ source code, databases, software, designs, media and text (“Content”) and their trademarks and logos (“Marks”). Intellectual property laws protect the Content and Marks. We provide them as is for personal, non-commercial aesthetic consultation.

Subject to these Terms, we grant you a revocable, non-exclusive, non-transferable license to access the Services and download, save, print and share your generated styling reports and consultation cards for personal use and consultation with your stylist.

If you send us feedback, ideas or suggestions about the Services (“Submissions”), you assign their intellectual property rights to us.

You retain ownership and copyright in your original self-portrait. You grant us a limited, revocable, royalty-free license to process it to provide simulations, facial-analysis results and consultation cards. Evna does not itself train AI models on your portraits or private reports. We send photographs to our hosted AI provider for processing as described in the Privacy Policy; that provider’s data handling is governed by its applicable service terms and our production settings.

3. User Representations and Adult Requirement

You confirm that you are at least 18 and at least the age of majority where you live; minors may not use Evna. Every uploaded photo must be an authentic portrait of you as an adult that you may lawfully submit. Do not upload photos of minors or other people.

Photos must meet our fully clothed, professional-framing rules and may not contain nudity or sexual content. Your account information must be accurate and current. You must obey applicable law and must not scrape or access the Services through unauthorized automated tools.

4. User Registration

You may need an account. Keep your credentials confidential; you are responsible for use of your account. You may request account deletion in your account settings. Our Privacy Policy explains removal from active systems and the retention that may apply to backups, providers and legally required records.

5. Purchases and Payment

We accept Visa, Mastercard, American Express and Discover. Stripe, Inc. processes payments. By confirming a purchase at checkout, you authorize the charge shown. Prices are in US dollars and Stripe’s terms also apply.

6. One-Time Purchases and Refunds

Evna currently sells reports and optional additions as one-time purchases at the price shown before checkout. These purchases do not automatically renew.

If a paid report or addition cannot be delivered, contact [email protected] so we can investigate and try delivery again where possible. We provide refunds or other remedies where required by law; your statutory consumer rights remain available.

For EU, EEA or UK consumers, digital delivery may begin promptly after purchase. Any effect on a statutory withdrawal right depends on the express consent and acknowledgment required by applicable law; accepting these Terms alone does not waive that right.

7. Prohibited Activities and Image Safety

Use Evna only for its intended purpose. Do not upload, request, generate or transmit nude, sexually explicit or suggestive material; photos of minors or other people; or material that violates another person’s intellectual property or privacy rights.

Do not reverse engineer the Services or extract AI model weights; scrape content into a database without permission; or use the Services or outputs to train a competing AI product.

Automated image checks may reject a submission. Flagged submissions may be reviewed. Confirmed violations may result in proportionate account restrictions or suspension. We may notify authorities where legally required or appropriate. A rejected image alone does not automatically cause a permanent ban, forfeiture of purchases or a law-enforcement report.

8. User Generated Contributions

If the Services offer review feedback or community discussion, you warrant that what you contribute does not infringe anyone else’s rights.

9. Contribution License

We do not claim ownership of your personal photographs. You retain their ownership and copyright.

10. Guidelines for Reviews

If reviews or ratings are available, base them on firsthand experience. Do not submit profanity, discriminatory remarks or false statements.

11. Mobile Application License

If you use the App, we grant a revocable, non-exclusive, non-transferable, limited right to install and use it on a device you own or control.

12. Social Media

You may connect your account to a third-party social account, such as Google, where this functionality is available.

13. Third-Party Websites and Content

The Services may link to third-party sites or include third-party articles, photos or other content.

14. Advertisers

Advertisers or affiliate partners may display relevant aesthetic content in parts of the Services.

15. Services Management and Enforcement

We may monitor compliance with these Terms, refuse non-compliant images, restrict accounts after review and report illegal activity where required or appropriate.

17. Copyright Infringement Notices (DMCA)

Fllio, LLC respects others’ intellectual property rights. If material on the Services infringes your copyright, send a written DMCA notice to [email protected] with the subject “DMCA Takedown Notice.”

Include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the allegedly infringing material and information sufficient to locate it, including a URL; (4) your address, phone number and email; (5) a statement of your good-faith belief that the use is unauthorized; and (6) a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act for them.

18. Term and Termination

These Terms apply while you use the Services. We may deny or restrict access for breach of these Terms or safety rules, subject to applicable law.

If your account is terminated for a violation, including the adult-only or image-safety rules, you must not create another account under your name or someone else’s name to evade that restriction.

19. Modifications and Interruptions

We may change or remove Service content or interrupt the Services, subject to applicable law.

20. Governing Law

Florida law governs these Terms and use of the Services, except where mandatory consumer law provides otherwise.

21. Dispute Resolution

The parties will first try to resolve a dispute informally for at least 30 days. Subject to applicable consumer law, unresolved disputes are to be resolved by individual binding arbitration in Miami-Dade County, Florida.

22. Corrections

Information on the Services may contain errors or omissions. We may correct them.

23. Disclaimer

The Services are provided “as is” and “as available.” To the fullest extent the law permits, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

24. Limitations of Liability

To the extent permitted by law, our liability for any claim is limited to the lesser of what you paid us in the 12 months before the claim arose or US $1,799.

25. Indemnification

You agree to defend and indemnify us against claims, losses and expenses arising from photographs you upload or your use of the Services, to the extent permitted by applicable law.

26. User Data

We maintain some data you provide to operate the Services. See our Privacy Policy for what we keep and how to request deletion.

27. Electronic Communications, Transactions and Signatures

You agree to receive electronic communications and that electronic agreements, notices and disclosures meet any applicable writing requirement.

28. SMS Text Messaging

If you opt into an available SMS program, you consent to receive text messages at the mobile number you provide.

29. California Users and Residents

California residents whose complaint remains unresolved may contact the Complaint Assistance Unit of the California Department of Consumer Affairs.

30. Miscellaneous

These Terms and any policies we post form the entire agreement between you and us regarding the Services.

31. No Professional Advice

Evna is for aesthetic visualization and hairstyle simulation. We do not give medical, surgical or dermatological advice. Simulations and facial proportions are for styling inspiration only.
