Terms of Service & Safe Harbor Agreement
Last updated: August 2026
Welcome to Evna. By accessing or using our non-surgical facial morphology analysis, hairstyle styling simulation, and stylist blueprints, you agree to be bound by these Terms of Service. If you do not agree, do not access or use our platform.
1. Acceptance of Terms & Service Scope
Evna provides digital facial proportion analysis and aesthetic hair simulation solely for personal grooming, styling guidance, and hair salon consultations. Our services do not provide medical diagnosis or surgical advice.
2. Zero Tolerance for Illegal & Prohibited Content
You are strictly prohibited from uploading, generating, distributing, or transmitting any content that is illegal, harmful, or non-consensual. We enforce an absolute zero-tolerance policy against:
- • Child Sexual Abuse Material (CSAM) or Child Sexual Exploitation and Abuse (CSAE) in any form;
- • Non-consensual intimate imagery, unauthorized deepfakes, or impersonation of living individuals or public figures;
- • Severe violence, gore, weapons, self-harm promotion, or hate speech targeting protected groups;
- • Content that infringes upon third-party copyrights, trademarks, publicity rights, or privacy rights;
- • Automated scraping, denial-of-service attacks, or unauthorized penetration of our storage buckets and APIs.
You must only upload genuine, unmanipulated self-portraits of yourself. Any attempt to upload prohibited content results in immediate permanent suspension and statutory reporting.
3. Mandatory Law Enforcement & NCMEC Reporting
As a responsible digital platform provider, Evna complies with all federal and international child safety laws, including 18 U.S.C. § 2258A. If severe illegal content (including CSAM/CSAE) is detected on our systems or storage buckets, we are legally mandated and unconditionally committed to report the incident, technical metadata, and associated identifiers immediately to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and appropriate law enforcement authorities.
4. Safe Harbor Protections & DMCA Takedown Procedure
Evna operates under the Safe Harbor protections of the Digital Millennium Copyright Act (17 U.S.C. § 512), Section 230 of the Communications Decency Act, and the EU Digital Services Act. If you believe your copyrighted work or personal likeness appears without permission, submit a formal takedown notice to our designated agent at [email protected] with: (a) identification of the copyrighted work/likeness, (b) URL or identifier of the material, (c) your contact information, and (d) a statement of good faith belief.
5. Automated Upload Interception & Storage Security
All user uploads are transmitted via short-lived, encrypted presigned URLs generated exclusively by our authenticated backend. Unmonitored direct public uploads to our Cloudflare R2 storage are strictly prevented. Every incoming image is intercepted and processed through automated content moderation scanners prior to persisting paths or initiating AI morphology workflows.
6. Biometric Privacy & Ephemeral Processing
Uploaded facial photographs are analyzed ephemerally to measure proportions for your session. Raw photos are encrypted at rest (AES-256) in private storage. We never sell biometric data or use user photos to train public foundational AI models.
7. Public Violation & Abuse Reporting
Any user or third party can submit reports of suspected policy violations, illegal content, or unauthorized likeness use directly through our Report Abuse form or by emailing [email protected]. All reports are prioritized and investigated swiftly by our Trust & Safety team.
8. Disclaimer & Limitation of Liability
Evna services and AI visualizations are provided "as is" for aesthetic visualization purposes only. Evna does not guarantee identical real-world haircut outcomes and assumes no liability for styling choices made with third-party salon professionals.
